Tensor Sticky Points Loyalty Programme Terms and Conditions

These Tensor Sticky Points Loyalty Programme Terms and Conditions ("Agreement") are a legal contract between Quin Global (UK) Limited, a company incorporated in Scotland (company number SC416328) , whose registered office is at Unit 3, Gateway Business Park, Beancross Road, Grangemouth, FK3 8WX ("the Company") and you ("Member"). The Company can be contacted by email by sending a message to info.uk@quin-global.com. You should review this entire agreement before you decide whether to participate in the Tensor Sticky Points Loyalty Programme (Programme).

BY ACCESSING OR USING THE PROGRAMME, INITIATING A TRANSACTION THROUGH THE PROGRAMME WEBSITE OR BY POSTING ANY CONTENT THROUGH THE PROGRAMME WEBSITE OR PROGRAMME SOCIAL MEDIA PAGES LOCATED ON THIRD PARTY WEBSITES YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT. If you are entering into this Agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity, in which case the terms "you" and "your" in this Agreement will refer to such entity.

1. Definitions

In this Agreement, the following words shall have the following meanings:
Promoter – Quin Global (UK) Limited, (company number SC416328), whose registered office is at Unit 3, Gateway Business Park, Beancross Road, Grangemouth, FK3 8WX
Products - Tensor products which offer Rewards under the Programme
Loyalty Programme - a marketing tool incorporating company products in which Rewards are offered to consumers or users of the company products by the Promoter
You / Member – consumers or users of the company products who collect points for redemption against Rewards and who join the Programme creating a Tensor Sticky Points account
Product Codes - a unique code acting as a unit of loyalty currency providing the Member with points which can be redeemed for Rewards in the Programme
Reward Manufacturer – company supplying products for the Points Rewards
Points Reward – product provided by a Reward Manufacturer
Reward Provider – companies offering promotions, experiences and prizes which are not Products
Promotional Reward – promotion, experience or prize offered by the Programme
Rewards - Collectible item or experience that can be redeemed with points or entry into a competition / prize draw with the opportunity to win a prize
My Account – Consumer or user Tensor Sticky Points Account

2. General

2.1 The Tensor Sticky Points Loyalty programme is open to residents of the UK, the Isle of Man, the Channel Islands and the Republic of Ireland aged 18 or over, excluding employees of the Promoter or Loyalty Bus Limited and their immediate families, agencies, or anyone else professionally connected with the Programme or promotion. Please check individual promotions on the website as restrictions to some areas may apply.

2.2 Purchase of a qualifying Tensor product is necessary and internet access is required to participate.

2.3 By registering with the Programme you agree to set up an account entitled My Account, and Members agree that they have read and understood the terms and conditions of this Agreement and agree to comply with them.

3. Membership of the Programme

3.1 Members are required at all times to provide true and accurate information to the Promoter.

3.2 In the event that a Tensor Sticky Points account is dormant or inactive for a period of 18 months or more the Promoter shall endeavour to contact the relevant Member through their nominated email address to notify them that their Tensor Sticky Points account is at risk of removal. Those who reply within 30 days requesting the Tensor Sticky Points account remain active will have their Programme Tensor Sticky Points account balances maintained. In the absence of a satisfactory response, the accrued balances will be forfeited, and the Member's Tensor Sticky Points account may be removed.

3.3 Programme Tensor Sticky Points accounts and point balances are not transferable.

4. Participation in the Programme

4.1 Purchase of a qualifying company product is required to participate in the Programme.

4.2 How to participate:-
    a. Register as a Member of the Tensor Sticky Points Loyalty Programme through the website www.tensorglobal.com and create a Tensor Sticky Points account;
    b. Enter the unique code found on your products. Different products have different points values. If you encounter a problem with your code or it is missing or unreadable, please contact us at:-

  • Unit 1, Ruthvenfield Avenue, Inveralmond Industrial Estate, Perth, PH1 3WB, United Kingdom or
  • by using the contact us form on this website

    c. Additional bonus points can be awarded through promotional activity that will be communicated by the Promoter from time to time during the promotional period;
    d. Identify, on the website, the Reward that you wish to collect for, and once you have collected sufficient points, follow the online instructions to claim your Reward;
    e. Points can be redeemed against any Reward offered in the Programme provided you have sufficient points and the Reward is still on offer on the website.

4.3 Please retain your stickers or product packaging with the unique codes as these may be requested by Promoter.

4.4 Points collected by Members can be redeemed as follows:
     • Redemptions against Points Rewards 
     • Redemption against a Promotion Reward offered by the Programme or a Reward Provider
     • Entry into a competition or prize draw offered by the Programme or a Reward Provider with the opportunity to win a prize. Once a Member has collected sufficient Points for entry into a competition or prize draw offered by the Programme or a Reward Provider, and created a Programme Tensor Sticky Points account they follow the instructions for entry into the competition / prize draw as noted on the website.

4.5 Please retain your unique code sticker or packaging, and invoice as proof of purchase may be required.

5. Points

5.1 Members are only entitled to earn points as set out under these Terms and Conditions and through authorised communications by the Promoter and these means and amounts are subject to change from time to time. Members not correctly following any required instruction or procedure may result in no points being earned or the Promoter may, at its sole discretion, refuse to process a claim and terminate the relevant Member's Tensor Sticky Points account.

5.3 All transactions are electronically monitored through a third-party network and each transaction is reported to the Promoter by the third party network. The Promoter cannot be held responsible for system failures by the third party network or a Reward Provider.

5.4 Please note that while we want to encourage you to collect points and enjoy the benefits of the programme or promotion we actively discourage misuse. DO NOT purchase more Product than you can reasonably use, just to claim a Reward.

5.5 Systems are in place to identify attempts at code guessing, cheating or suspected misuse, and the Promoter reserves the right to request proof of purchase, such as the physical unique code stickers and invoices.

5.6 If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, refuse to process a unique code or a claim and terminate a Tensor Sticky Points account. These reasons include, but are not limited to:-

  • Attempting to collect or redeem points in contravention of these Terms and Conditions;
  • Attempting to have, or having, multiple Tensor Sticky Points accounts;
  • Any fraudulent activity with respect to copying coupons, vouchers or purchasing or trading points;
  • Interfering with the Tensor Sticky Points Loyalty Programme or the points website;

5.7 The Promoter will be the final arbiter in any decisions and these will be final and binding.

5.8 Members are responsible for any tax implications or payment of tax, if any, that may arise through collecting points pursuant to the Programme. All incentive awards are liable to attract taxation as a "benefit in kind". All Members are responsible for reporting full benefit details direct to HM Revenue and Customs and the Promoter shall not be held responsible or liable in any circumstances for any tax liabilities whatsoever arising from the Programme's incentive awards. It is the individual Member's own responsibility to ensure that this Agreement complies with their company's or employer's (as the case may be) reward policies and any other relevant policies. The Promoter accepts no responsibility or liability whatsoever in the event that this Agreement does not comply with any such policies

5.9 Members must have sufficient points accrued in their Tensor Sticky Points account in order to claim any Reward.

6. Rewards and Redemptions

6.1 Rewards and their descriptions are supplied or provided by the Reward Provider and the Promoter makes no warranty in respect of such Rewards. The Promoter disclaims any and all warranties, including, but not limited to, the implied warranties of satisfactory quality, fitness for purpose, and non-infringement. The Promoter is not responsible for those guarantees, warranties, and representations, if any, offered by Reward Providers. No advice or information, whether oral or written, obtained by a Member under the Tensor Sticky Points Loyalty Programme shall create any warranty by the Promoter.

6.2 Some Rewards may include the exchange of accumulated points for experiences which will be subject to other Providers' standard terms and conditions and health or other restrictions. Travel or other incidentals are not included unless stated.

6.3 Members understand that there may be a delay in crediting points for Rewards due to the third party transaction processing provider used by the Promoter's failure to provide necessary information to the Promoter. The Promoter shall not be responsible or liable for the delay or failure to credit points in such event.

6.4 Please allow up to 28 days for delivery of Rewards unless otherwise indicated.

6.5 The Promoter reserves the right at any time, and from time to time, without notice, to:

  • Withdraw, modify or limit Rewards offered by Promoter and / or Reward Providers in the Tensor Sticky Points Loyalty Programme and/or the number of points required to redeem for Rewards;
  • Change Rewards or Reward Providers

6.6 The Promoter cannot accept any liability for:

  • Non or late delivery of Rewards to the Member;
  • Faulty Rewards;
  • Inaccurate description of the Reward on the Tensor Sticky Points Programme website;

7. Promotion Period

7.1 The Promoter reserves the right to terminate the Tensor Sticky Points Loyalty Programme at any time. Any notice of termination shall be posted on this Tensor Global website and Members will have 90 days from this date to redeem any points in accordance with these Terms and Conditions. Unless specified otherwise, no additional points will be able to be accrued during this termination period.

7.2 The Promoter will make every effort to communicate the termination period to all Members, however the Promoter will not be held responsible for failing of such notification to reach any individual Member regardless of the reason.

8. Indemnity

8.1 By participating in this promotion and agreeing to these Terms and Conditions, you agree to the Promoter's Privacy Policy

8.2 If you have opted in to receiving emails or SMS messages from the Promoter, then you agree to allow the Promoter to communicate with you via email or SMS with opportunities to earn and redeem points or other relevant offers. The Promoter will always use this communication method responsibly under the terms of the Data Protection Act 1998 and other self-regulatory restrictions. Members preferring not to receive such offers can visit their account information page and change their communication preferences to opt-out of receiving such offers from the Promoter.

8.3 If a Member decides to leave the Tensor Sticky Points Loyalty Programme, the Promoter will cease further communication with that Member regarding the Programme and their Tensor Sticky Points Account will be closed within 60 days and any unused Points will be forfeited.

8.4 The Promoter may from time to time adjust Members' Tensor Sticky Points accounts upwards or downwards in respect to accounting errors, multiple accounts, refunds issued, Rewards returned or suspected fraud, for which the Promoter has full authority.

8.5 The Promoter reserves the right to amend these Terms and Conditions and/or the operation of the Tensor Sticky Points Loyalty Programme at any time. Any amendment shall be effective upon posting the modified Terms and Conditions and/or modified Tensor Sticky Points Loyalty Programme on this Tensor website and notifying Members either on the Tensor Sticky Points website home page or via email. In the event of an amendment to these Terms and Conditions, a Member's non-cancellation or continued use of the Programme after 30 days shall be deemed acceptance of the modified Terms and Conditions and/or Tensor Sticky Points Loyalty Programme.

8.6 You agree to indemnify and hold the Promoter, its affiliates, officers, and employees harmless from and against any claim, demand, expense, or damage, (including reasonable legal fees) relating to a Member's breach of these Terms and Conditions including the posting of any material on any of the Tensor or Programme Social Media websites.

8.7 To the fullest extent allowed by law, the Promoter accepts no responsibility for loss, damage or injury suffered by a Member as a result of participation in this promotion.

8.8 Any dispute under the Tensor Sticky Points Loyalty Programme will be resolved by the Promoter. In the event of error or omission on the part of the Promoter, the Promoter's liability to the relevant Member is limited to crediting disputed points or account balances to that Member's Tensor Sticky Points account.

8.9 Any queries regarding the Programme must be sent in writing to the Promoter at:-

8.10 These Terms and Conditions shall be subject to the laws and jurisdiction of Scotland. The Promoter's failure to enforce strict performance of any provision of these Terms and Conditions will not constitute a waiver of the Promoter's right to subsequently enforce such provision or any other provision of these Terms and Conditions.

8.11 By signing up to the Tensor Sticky Points Loyalty Programme Members hereby confirm, acknowledge and agree :- (i) that the incentives offered by this Agreement and such Programme have not been offered in order to induce them to perform any activities improperly or to reward them for any improper performance of any activities ; (ii) that by doing so they are not acting in breach of any of their company's or employer's (as the case may be) policies whatsoever
